Egyptian Bulk Carrier Detained At India’s Paradip Port Over Unpaid Debt To German Firm

The MV Wadi Albostan, an Egyptian ship, was arrested at Paradip Port in Odisha after an order from the Orissa High Court.

The arrest was carried out on August 14, 2024, due to a legal dispute over an unpaid debt of Rs 3.96 crore owed to a German company, Elboil GmBH, for delivering low-sulfuric marine gasoil.

The vessel, en route to China to transport 55,000 metric tonnes of iron ore, arrived at India’s Paradip Port on August 6, 2024.

However, Elboil GmbH took legal action by filing an admiralty complaint in the Orissa High Court, claiming USD 477,326.86 (equal to Rs 3.96 crore) for the supply of 98.599 metric tons of very low sulfur fuel oil.

The court found sufficient evidence to support the plaintiff’s case and ordered the ship’s detention to prevent it from departing the port.

Justice V Narasingh, acting as Admiralty Judge, appointed Civil Judge (Senior Division) Kujang as Marshal to execute the arrest warrant.

The detention was carried out in the presence of local police, and the Paradip Port Authority was ordered to assist in the operation. The Marshal has been instructed to report the detention to the Orissa High Court’s Registrar (Judicial) within seven days.

The ships’ arrest marks the third such incident in Paradip Port in the past four months, highlighting the region’s growing legal action over maritime issues.

MV Wadi Albostan will remain in custody at Paradip Port until further notice from the court. SP Rahul PR confirmed the arrest, stating that all procedures complied with the high court’s orders.
